Privacy Statement:

Best on the Coast will collect personal information about you. Our primary purpose in collecting this personal information is to enable us to provide services to you. We require this information for the purposes listed below, and if you choose not to provide the information requested, we may not be able to provide the services to you. This information may be used for related purposes, such as: to assist in providing goods and services to you, to assist with any enquiries you make to us, for any purpose made known to you at the time of collection of your personal information, to communicate promotional offers, business referrals and special events, for our internal administrative, marketing, planning, product development and research requirements, in connection with law enforcement, national security and airport surveillance and in relation to our business marketing program. We usually disclose information of this kind to: Best on the Coast Pty Ltd as trustee for The Best Trust, third parties such as consultants, auditors, legal advisors and the like, third parties we are required by law to disclose to. Under the National Privacy Principles, you may access your personal information held by Best on the Coast. You may contact us if you think any of this information is inaccurate, incomplete or out of date. There are some limited situations, which are set out in the National Privacy Principles, where you do not have this right. In agreeing to the above, I acknowledge that the National Privacy Principles are set out under the Privacy Act 1988 (Commonwealth) do not apply to the collection, use and disclosure of my personal details by entities outside of Australia

 

Terms:

Please note that the primary function of Best on the Coast is to promote its member's businesses. The prospective business nominee (‘applicant’) acknowledges that whilst Best on the Coast does carefully check on, and monitor the reputation and credit worthiness of all applicant organisations, it does not warrant the capabilities or professional expertise of any of its members. Therefore, the Applicant in choosing to conduct business with or refer clients to any other member of Best on the Coast does so at its own volition and risk. Best on the Coast specifically accepts no liability in relation to business conducted or standards as between any of its members

 

Authority

The Applicant authorizes and permits Best on the Coast to make any enquiry search or check whatsoever associated with this application including, but not limited to, credit checks with appropriate organizations and institutions, industry bodies, referees and otherwise as Best on the Coast may in its discretion decide. The Applicant also authorizes the distribution and receipt of emails within and by the Best on the Coast members associated with this application and if approved thereafter

 

Mediation:

If a dispute arises in connection with this Agreement, a party to the dispute must give to the other party a dispute notice specifying the dispute and requiring its resolution under this mediation clause (Notice of Dispute). The Director or responsible person of each party (Nominee) must confer within three days after the Notice of Dispute is given to try to resolve the dispute. If the dispute is not resolved within seven days after the Notice of Dispute is given, the dispute is by this clause submitted for resolution, conducted on the Sunshine Coast close to where the party giving the Notice of Dispute is located. The Institute of Arbitrators and Mediators Australia Mediation and Conciliation Rules (at the date of the Agreement) apply to the mediation. Despite anything else in this clause, a party may at any time commence court proceedings in relation to any dispute under or in connection with this Agreement where that party seeks interlocutory relief. This clause applies even where the Agreement is otherwise void or voidable

 

Limitations on Liability:

Notwithstanding any other provision of this Agreement, any liability to involving Best on the Coast, its Leadership Team members, Director, officers and representatives for any cause whatsoever arising from a breach of the conditions or warranties, if any, in this Agreement, related to this Agreement, or membership or participation in Best on the Coast or both, and regardless of the form of the action, will to the extent permitted by law be limited to the amount of annual membership dues paid by you for the membership of Best on the Coast. Except in jurisdictions where such provisions are restricted, in no event will there be a liability or any third party for any indirect, consequential, exemplary, incidental, special or punitive damages.

 

By signing this application form I confirm that all details are true and correct and I agree to be bound by the terms and conditions of this application and the Policies, Program Guidelines and Code of Conduct of Best on the Coast, including as amended from time to time. I acknowledge that if I breach these terms and conditions, including the Policies, Program Guidelines and Code of Conduct of Best on the Coast, Best on the Coast may terminate our business membership in which case we will not be entitled to a refund.

I have read and understood all Best on the Coast General Policies, Administrative Policies, Program Guidelines and Code of Conduct and further understand that upon acceptance to Best on the Coast, fees are not refundable

 

General Policies

 

1. Only a limited number of members will be allowed to join Best on the Coast to maintain exclusivity and yet offer consumers a choice of provider. The actual number of industry sectors, sub-categories and individual members will be determined on an annual basis based on industry size and the thickness of the market. This determination will be done by Best on the Coast in conjunction with the Leadership Team.

 

2. The member organisation must be located and operate within the Sunshine Coast Regional Council boundaries.

 

3. In general, the member organisation should have been operating as a full-time business on the Sunshine Coast for at least two years 4. Members must maintain a fulltime business and their membership must be in their primary industry area.Notwithstanding, member organisations may market their other services but will only be listed in the Directory in their member industry category.

 

5. It is the responsibility of the nominee of any member organisation to immediately notify the Best on the Coast office of any issue pertaining to their business that may have a negative effect on the Best on the Coast brand and/or any of its members. Failure to do so will result immediate cancellation of membership. Within four hours of such advice an extraordinary meeting of the Leadership Team and the Director will be held to determine the best course of action. This meeting may be held via telephone or video conference if necessary to comply with these timelines.

 

6. All member businesses must identify a nominee who will be the primary point of contact with Best on the Coast and the Leadership Team. It will be necessary to also nominate a secondary nominee in case the nominee is absent and the matter is urgent.

 

7.The Nominee needs to be a person who has substantial control and influence in the member business, and ideally be at Director or Owner level.

 

8. Membership is granted for one year only with members needing to apply to renew their membership for subsequent years. An application fee of $220.00 (including GST) will be levied for the first year only.

 

9. Membership fees are $220.00 per month (including GST) and will be levied on a monthly basis, preferably by direct debit, with a commitment for the entire year on application or renewal. The total yearly commitment being $2 640 p.a. (including GST). Additional fees may apply for other payment methods.

 

10. All members shall be entitled to the payment of affiliate fees for other members introduced to, and accepted by Best on the Coast. These payments are calculated as follows: Level One: 20% of membership fees paid by the member directly introduced and nominated on the application form; and Level Two: 5% of the membership fees paid by members subsequently introduced by a member to whom a Level One affiliate fee is payable. These are the only two levels of affiliate fees payable and will be allocated only after they have been received to the contributing member, with 10% of the net amount being compulsorily allocated to a charitable fund.

 

11. All members must nominate a valid bank account into which any affiliate fees payable will be paid. This can be any account they wish and may include charitable organisations, sporting or social clubs. Members may change this account every six months without charge. However, should members wish to change this nomination more frequently, a fee of $20.00 plus GST will apply.

 

12. In any hung decision of the Leadership Team where agreement cannot be reached, the Director shall have the deciding vote. This should only happen in unusual and exceptional circumstances.

 

13. In the event that a meeting of the Leadership Team cannot be convened in a timely manner for whatever reason, the Directors and Shareholders of Best on the Coast Pty Ltd shall have the power to make any decision required in the best interest of Best on the Coast.

 

14. A quorum of at least four members of the Leadership Team will be required to conduct the fortnightly meeting. However, no final decision will be ratified until the absent Leadership Team members have had 48 hours to raise any issues or concerns. If no communication is received from any Leadership Team member within this time, it will be deemed that they agree with the meeting’s recommendation.

 

15. In the case of problems or concerns with a member, the Leadership Team may, at their discretion put the member business on probation for a period of probation to rectify the issue/s.

 

16. These policies may change from time to time. However, all nominees will be notified by email within 48 hours of the detail of the change. Any proposed policy changes will be reviewed by Best on the Coast and possibly the Leadership Team before any decision is made. Administrative Policies:

1. There is an initial application fee, which is primarily to cover the administrative cost of processing the application, conducting reference checks and company searches as deemed necessary from time to time. Membership fees are payable monthly, ideally by direct debit, as other forms of payment may attract additional fees. All fees quoted do not include GST which will need to be added. Payments by credit card will attract a 1.5% surcharge.

 

2. All membership fees received shall be dispersed in the following manner:
» Marketing 55%
» Affiliate Fees -Level One 20%*
» Affiliate Fees-Level Two 5%*
» Administration & Management 15%
» Dividend to Entity 5%

* Please Note: 10% of all affiliate fees will be compulsorily withheld for a centralised charitable fund.

 

3. Fees are non-refundable. However should a member apply and be declined, their payment will be returned minus the application fee, which will have been expended in initial processing.

 

4. Best on the Coast has a strict policy on returned cheques and refused credit card payments. A nominee has three working days in which to contact the Best on the Coast office to resolve any such issue. All returned or dishonoured cheques will incur a minimum $50.00 returned cheque fee payable by that member. If a member business passes a second returned cheque of refused credit card payment, their membership may be cancelled.

 

5. Best on the Coast is a marketing concept provided by Best on the Coast Pty Ltd ATF the Best Trust trading as Best on the Coast and reserves the absolute right to refuse admission or discontinue membership in Best on the Coast

 

General Guidelines:

1. A member’s membership expires at the anniversary of their joining or renewal of membership. Membership is payable monthly, but with a yearly commitment to participate in Best on the Coast. Following the Leadership Team’s approval for renewal the membership will be extended.

 

2. A membership business may change their nominee and/or secondary contact. However, they will need to apply to the Leadership Team for approval of the ‘new’ nominee or contact, who will primarily assessed to see if they are a fit person who is involved substantially fulltime at an appropriate management of leadership level to exert the necessary control on the businesses actions.

 

3. Best on the Coast utilises intellectual property and trademarks under licence.

 

4. Member businesses and nominees are not agents or partners of Best on the Coast, but are permitted use the intellectual property and trademarked logos in their marketing collateral, strictly in accordance with the approved terms of use.

 

5. A cancelling or non-renewing member business of Best on the Coast has 30 days to remove the Best on the Coast image, logo or intellectual property from their marketing, administrative or other systems or face legal action.

 

6. Each member and their nominee agrees not to take any action or make any claim against any member of the Leadership Team for any matter relating to Best on the Coast.

 

7. Best on the Coast is the only entity entitled to represent Best on the Coast in any relationship with the public via the media and no member is authorized to speak or publish material on behalf of Best on the Coast.

 

8. Each member and their nominee will indemnify Best on the Coast against any liability or costs incurred directly or indirectly by Best on the Coast as a result of statements or actions of any member.

Upon acceptance of this Application as signified by endorsement on the foot of this document by Best on the Coast the above terms and provisions shall form part of the Agreement between the Applicant and Best on the Coast.

 

I have read understand and agree to all Best on the Coast General Policies, Administrative and Privacy Policies and the Best on the Coast Code of Ethics and further understand that upon acceptance, fees are non refundable.

 

Acceptance of this Application shall be at the discretion of Best on the Coast in all respects and no reasons for refusal are required to be given.
